TERMS AND CONDITIONS

Forus Training’s goal is to fulfil and deliver on scheduled events with learners who have fully committed to the event. The following terms and conditions are in place to ensure that courses run, are well subscribed to, and are well attended. The provision of Forus Training courses is subject to these terms and conditions. Please read these carefully before registering for a course. These terms apply to all purchasers. You agree to our Terms and Conditions by registering on our courses. All current and upcoming course registrations and courses you attend are subject to our Terms and Conditions. At any time, we reserve the right to modify and revise our Terms and Conditions. Before you register for a course, it is your responsibility to read the most recent Terms and Conditions.

 

 

1. DEFINITIONS

1.1. For the purposes of these Terms: ‘We’ and/or ‘Us’ means Forus Training who will provide  the services to you. ‘You’ means the learner receiving the service. ‘Register’ means the process of registration, booking, ordering or enrolling on a course and the term ‘Registration’ shall be construed accordingly. 

1.2. Registration can take place through our website, this will involve you completing the relevant application form, providing us with your personal information so we can complete the registration on our side. Registration can also take place by telephone/email/Whatsapp or in person, this will involve you providing us details of the course you wish to study, providing us your payment details and agreeing to proceed with the purchase. By completing registration, you are agreeing to the terms and conditions set out herein. 

1.3. ‘Course Materials’ means the materials required to complete the Course; including the manual, workbook, assessment briefs, slide decks, quizzes and other resources, in paper, electronic format or other format where that option applies.

1.4. ‘Services’ include: 

1.4.1. The provision of the Course Materials in paper, electronic format or other format where that option applies; 

1.4.2. The provision of tutorial and other support including training, skills and

1.4.3. The provision of access to our Learning Management System (LMS).

1.5. ‘Course Fees’ means the amount owed for the provision of the Services.

1.6. ‘Assessment’ can include assignments, examinations or skills demonstrations. 

 

 

2. DATA PROTECTION AND PRIVACY POLICY

2.1 Forus Training is dedicated to protecting your privacy and the confidentiality of any information you provide to us. The information you provide is required to process your application. We may share your personal information with third parties as needed in order to process your application. Our Privacy Notice can be found here. You consent to the terms of our Data Protection and Privacy Policy by accepting these terms and conditions.

 

 

3. COPYRIGHT NOTICE

3.1. All material on Forus Training’s website, online LMS system, or printed materials are the copyright of Forus Training unless otherwise stated. Copyright is implied irrespective of whether a copyright symbol or a copyright statement is displayed. We own the copyright and other intellectual property rights in the text, graphics, information, designs, data and other content on our website and course materials. Forus Training reserves the right to amend any of the information contained in its course brochures and outlines. The Course materials and content on our website may not be reproduced for any purposes, including commercial purposes.

3.2. No part of the site and no content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, website or other medium for publication or distribution or for any commercial enterprise, without express prior written consent from Forus Training.

 

 

4. PROVISION OF COURSES

4.1. Course places are allocated on a first-come, first-served basis, based on payment of course fees or, if applicable, payment of your first instalment.

4.2. In the event of unforeseen circumstances or insufficient enrollment, Forus Training reserves the right to cancel or postpone a course. If we cancel a course or postpone it by more than 60 days from the original start date, the full fee is refundable to you.

4.3. If a course is oversubscribed, learners will be offered a seat on the next available course to run within 60 days of the original start date.

4.4. Course dates, days, and times are subject to change throughout the course and we would be informing you the same via email.

4.5. After registration, learners will get an email confirmation that contains the details of the course. The learners will be given access to Forus Training’s Learning Management System.

4.6. In order to complete the course, the learner is responsible for making sure they have all the required technical equipment. These may include specifications for the computer access, internet access, operating system, and software.

4.7. Learners will be unable to access Forus Training’s Learning Management System when the timeframe has lapsed.

4.8. Learners may not transfer their account to any other person and may not use anyone else’s account at any time.

4.9. Learners are given 18 months to complete a major award  from the date of registration to the date of completion. 

4.10 PPS Numbers & Foreign Enrolments – All QQI awards issued from QQI require the learner to hold an Irish or UK PPS number (Personal Public Service Number). Applicants and Learners are advised that if they do not carry a PPS number they will not be eligible to receive an award from QQI as it is a requirement of certification by QQI – the Irish National awarding body for our awards. Learners who do not hold this PPS number will only receive a completion certificate from Forus Training.

 

 

5. PAYMENT OF THE COURSE FEE

5.1. Before the commencement of a course, all fees must be paid in full, unless an instalment payment plan has been agreed upon, or a grantor or other third party, such as the Department of Employment Affairs and Social Protection, has approved funding in writing.

5.2. If your funding is withdrawn, or if your non-attendance or non-submission of funding/documentation/assessment material does not meet the funder’s criteria, you, the learner, must pay the full fee – Funding bodies include but not exclusively can be the Department of Social Welfare (INTREO), Community Employment Schemes, and other state bodies.

5.3. If you are funded by an employer once a learner commences a programme Forus Training have an obligation to see the training through with the individual, regardless of their employment status with the funder. We aim to safeguard a learner’s academic journey and to ensure that a learner can complete the programme that they have commenced. By agreeing to these terms and conditions the employer accepts liability for the course fee relating to that learner.

5.4. If you have paid course fees in part or in full and are then granted funding by a third party, you will be refunded when we receive payment from the funder.

5.5. If you choose to pay in instalments, you are entering a legally binding contract for which you will be personally liable. Payments are made on a periodic basis (fortnightly/monthly) and not for separate modules and therefore payments must be made when they fall due.

5.6. Learners are solely responsible for all service, telephony, data charges and/or other fees and costs associated with their access to and use of the Services, as well as for obtaining and maintaining all telephone, computer hardware, and other equipment required for such access and use. 

5.7. We do not offer returns or refunds on our learner packs. It is your responsibility to provide the correct address and contact information so that the learner pack can be posted to you. 

 

 

6. CANCELLATIONS, TRANSFERS AND NO-SHOWS

6.1. A learner may withdraw from a course after registering by submitting the Course Cancellation Request Form. This form must be submitted within 14 days of the original purchase date.

6.2. The right to cancel during the cancellation period is lost if:

6.2.1. Forus Training begins providing training at your request before the 14 day  cancellation period has passed,

6.2.2. The course is already open for you to begin,

6.2.3. If your course begins within the 14 day window and the course is provided to you within the 14 days. This is because the service has already been rendered before the 14 day cancellation period has passed,

6.2.4. If course materials or LMS online access details have been issued. Issuance of course materials or LMS access constitutes the commencement of services. This applies regardless of whether the learner has logged into the LMS or accessed the course. By registering, the learner acknowledges that these services are provided immediately and that no refunds will be granted once access details or materials are sent.

6.3. In the event of a cancellation, there is a non-refundable administration fee of €100. 

6.4. A grace period of two weeks will be provided if we are unable to collect instalment payments. Following that, there will be a fee of €10.50 for each missed instalment payment. 

6.5. If we are unable to collect instalment payments, the learners’ access to the course and tuition will be suspended, unless satisfactory payment arrangements are made.

6.6. In the event of a medical reason, a learner may put their course on hold for a maximum of six months by submitting the Course Deferral Request Form. The postponement will be considered at the sole discretion of Forus Training and will require submission of a valid medical certificate. Continuation of the payment plan will be necessary during the postponement period.

6.7. In the event that a course is discontinued, the learner will be refunded the amount back to the original payment source.

6.8. Course Transfers            

6.8.1. Learners may request a transfer to a course of the same or greater value, provided the original course has not been accessed through the LMS. If the transfer is to a course of greater value, the balance difference must be paid by the learner.

6.8.2. If the requested transfer is to a course of lesser value, no refunds will be provided for the difference in fees.

6.8.3. A Course Transfer Request Form must be submitted to initiate the transfer process. A non-refundable administration fee of €100 applies to all transfer requests, except where the transfer is requested for the same course in a different delivery format/method (e.g., classroom-based to online).

6.8.4. Transfers for the same course in a different delivery format/method are exempt from the €100 administration fee. Requests of this nature must be submitted using the Course Delivery Format Change Request Form and will be considered on a case-by-case basis.

6.8.5. For TESG-funded learners, transfers are not permitted without prior consultation and written approval from your named INTREO contact. It is the learner’s responsibility to initiate this consultation and obtain the required approval before submitting the relevant transfer request form.

7. DISCOUNTS/SPECIAL OFFERS

7.1. Any courses that have been discounted or are part of a special promotion are not eligible for refunds.

 

 

8. SUBMISSIONS, EXTENSIONS AND DEADLINES

8.1. When a learner registers on a course, submission dates will be provided to them. The time allowed to complete each course is detailed on our brochures. All learners who do not complete courses in the time-frame listed on the brochure, may be completely removed from the Active learner list if no formal extension is requested. If you have been removed from the registered learner and the learner may be liable for complete re-registration and full course payments again upon application.

8.2. Requests for extensions of this date may be made, but Forus Training retains the sole discretion to grant them. When applying for an extension, the learner needs to state the number of days/weeks required. Care must be taken to apply for the length of time required to avoid having to apply for an additional extension. A maximum of 2 extensions can be applied for.

8.2.1. Fees: Pre 01.07.2023 there is no fee for the first extension and there is a fee of €100 for the second extension. There is a late submission fee of €100 after that. 

8.2.2. Post 01.07.2023 there is a fee of €60 for the first extension. There is a fee of €100 for the second extension. No extension will be granted after this and a late submission fee of €120 will apply.

8.2.3. If a learner qualifies for a Major Award Certificate and is taking 6 or fewer related modules with Forus Training, they are responsible for paying the applicable QQI fee for the certificate. The fee is €80 for a Level 6 Major Award and €50 for a Level 6 Major Award. However, we will deliver the certificate to them without any additional charges.

 

 

9. EVENTS OUTSIDE FORUS TRAINING’S CONTROL

9.1. Forus Training will not be liable or responsible for any failure to perform or delay in performance of any of its obligations under the Conditions that is caused by events outside Forus Training’s reasonable control (a Force Majeure Event).  A Force Majeure Event includes any acts, events, non occurrence, omission or accident beyond the Forus Training’s reasonable control and includes, in particular (without limitation) the following:

9.1.1. strikes, lock outs or other industrial action; or

9.1.2. civil commotion, riot, invasion, terrorist attack or threat of terrorist attack or (whether declared or not) threat or preparation for a war; or

9.1.3. fire, explosion, storm, flood, earthquake, subsidence, epidemic, other natural disaster; or

9.1.4. impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; or

9.1.5. impossibility of the use of public or private telecommunication networks.

9.2. Forus Training’s obligations under the Agreement will be suspended for the period of the Force Majeure Event. Forus Training will take reasonable steps (if within its reasonable control) to bring the Force Majeure Event to a close or to find a solution by which Forus Training’s obligations under the Agreement can be performed despite the Force Majeure Event.

Can I get a refund/can I cancel?

Before booking your course, we kindly ask that you confirm your commitment. Once you’ve received access to our Learning Management System via email, we’re unable to process cancellations or offer refunds.
We emphasise this policy throughout the booking process to ensure clarity and transparency.

  • Definitions
    1. For the purposes of these Terms:
      1. ‘The Buyer’: The company or organisation purchasing the training services.
      2. ‘The Learner’: The individual(s) nominated by the Buyer to attend the course.
      3. ‘Registration’: The point at which the Buyer confirms a booking (written or verbal) for a specific number of individual places, a defined participant range (e.g., 12-15 learners), or a full course group. Registration is finalised upon the issuance of a booking confirmation, at which point these Terms and Conditions become binding and the Buyer becomes liable for the agreed fees.
      4. ‘Learner Enrollment Data’: The mandatory personal information (including but not limited to Name, Email, and PPSN) required to grant course access and process certification.
      5. ‘Course Materials’: The materials required to complete the Course; including the manual, workbook, assessment briefs, slide decks, quizzes and other resources, in paper, electronic format or other format where that option applies.
      6. ‘Services’: Includes the provision of Course Materials, tutorial and other support (including training and skills), and access to our Learning Management System (LMS).
      7. ‘Course Fees’: The amount owed for the provision of the Services.
      8. ‘Assessment’: Includes assignments, examinations, or skills demonstrations.
  1. 2. Registration & Data Submission
    1. Booking Confirmation: A booking is considered confirmed once the Buyer accepts the proposal. The Buyer is liable for the full fee based on the number of places or the participant range (e.g., 12–15) selected at the time of booking.
    2. Submission of Learner Enrollment Data: Where the Learner identities are not known at the time of booking, the Buyer acknowledges that the Learner Enrollment Data will be collected directly from the Learner by Forus Training on the first day of the course. Since full enrollment data is not available until the course commences, the Buyer accepts that:
      1. LMS Access: Full access to the Learning Management System (LMS) and digital resources may be delayed by up to 24–48 hours from the start of the first session while data is being verified.
      2. Certification Risk: If a Learner fails to provide accurate Enrollment Data, Forus Training cannot be held liable for delays in registration or QQI certification processing.

 

  • Data Protection and Privacy Policy
      1. Consent and Agreement: The Buyer consents to the terms of our Data Protection and Privacy Policy by accepting these terms and conditions. This consent applies to all personal data provided by the Buyer to Forus Training during the Registration and enrollment process.
      2. Provision of Learner Enrollment Data: The Buyer acknowledges that Learner Enrollment Data may be provided either by the Buyer prior to the course start date or directly by the Learner on the first day of the course. Where the Buyer chooses to provide full Enrollment Data, they warrant that they have a lawful basis under GDPR to share this information and have directed the Learner to our Privacy Notice; alternatively, where the learner provides the Learner Enrollment Data, the Buyer accepts that all enrollment identifiers must be submitted directly by the Learner to Forus Training at the point of course commencement to satisfy regulatory and certification requirements. Where the Learner provides their own data, the Learner is acknowledging and agreeing to the Forus Training Data Protection and Privacy Policy to ensure direct compliance.
      3. Processing of Data: The information provided is required to process the application and fulfill the contract. Forus Training will process this data in accordance with our Privacy Policy. We may share personal information with third parties (such as QQI or other regulatory bodies) only as needed to process the application and secure certification.

  • Provision of Services
      1. Delivery of Course: Forus Training will provide the Services (as defined in Section 1) with reasonable care and skill. We reserve the right to change the trainer, the platform, or the venue (where applicable) provided the quality and content of the course remain consistent.
      2. Access Conditions: The provision of the Services is strictly conditional upon the Buyer providing the Learner Enrollment Data as set out in Section 1.2.
      3. LMS and Online Access:
        1. After Registration is finalised and the Learner Enrollment Data has been received, each Learner will receive an email confirmation containing their course details.
        2. Learners will be granted access to Forus Training’s Learning Management System (LMS) only after their data has been successfully processed.
        3. Access to the LMS is granted on an individual basis and login credentials must not be shared between Learners or with the Buyer’s administrative staff.
        4. Access to the LMS is time-bound and will be revoked once the designated course timeframe has lapsed.
      4. Delivery of Physical Materials: Where a course includes printed manuals or workbooks, these will be dispatched to the Buyer’s address or provided in-class.
      5. Prerequisites and Eligibility: It is the Buyer’s responsibility to ensure that all nominated Learners meet the minimum entry requirements (e.g., prior qualifications or language proficiency) for the course. Forus Training reserves the right to refuse service to any Learner who does not meet the specified prerequisites.
      6. Technical Requirements: In order to complete the course, the Buyer must ensure that Learners have access to the required technical equipment, including stable internet access, compatible computer hardware, and necessary software.
      7. Cancellations or Postponements by Forus Training:
        1. In the event of unforeseen circumstances or insufficient enrolment, Forus Training reserves the right to cancel or postpone a course.
        2. If a course is oversubscribed or cancelled by Us, the Buyer will be offered a full refund or a seat for the Learner on the next available course.
        3. If Forus Training postpones a course by more than 60 days from the original start date, the Buyer is entitled to a full refund of the Course Fees.
  • Payment of the Course Fee
      1. Liability for Fees: Upon Registration (as defined in Section 1.1), the Buyer becomes liable for the full Course Fees based on the number of places or the participant range selected.
      2. Range-Based Pricing: Where the Buyer has booked a participant range (e.g., 12–15 learners), the fee is fixed for that range. If the actual number of Learners nominated by the Buyer is fewer than the minimum of the range, no refund or reduction in Course Fees will be provided.
      3. Payment Terms:
        • Unless otherwise agreed in writing, all Course Fees must be paid in full within 14 days of the invoice date.
        • Forus Training reserves the right to withhold Services, including LMS access and the dispatch of Course Materials, until payment has been received in full.
        • No certification will be processed with QQI or other awarding bodies until all outstanding fees related to the Learner(s) have been settled by the Buyer.
  • Cancellations, Transfers and No-shows
  1. Course Cancellation Fees and Liability: In the event of a written cancellation, the amount payable to Forus Training is determined by the date the request is received in relation to the confirmed Course Start Date. This fee schedule applies to the Buyer as a binding liability regardless of whether the Course Fee has been paid or if LMS access has been issued, as the penalty is tied to the service commitment and the reserved capacity.

1.1 If the Course Fee has not been paid: The Buyer is liable for, and must remit, the cancellation fee outlined below within 14 days of the written cancellation notice.

1.2 If the Course Fee has been paid in part or in full: Forus Training will retain the applicable cancellation fee amount and refund any remaining balance of the Course Fee paid.

2. Cancellation Timelines: The total Course Fee remains due in accordance with the following timelines: 

2.1 More than 30 calendar days before the Course Start Date: A non-refundable administration fee of €50 per participant (or €500 for fixed-price group/range bookings where participant numbers are unknown) will be retained.

2.2 Between 15 and 30 calendar days before the Course Start Date: 25% of the total Course Fee will be retained or remains due.

2.3 Between 1 and 14 calendar days before the Course Start Date: 50% of the total Course Fee will be retained or remains due.

2.4 On or after the Course Start Date, or a ‘No-Show’: 100% of the total Course Fee will be retained or remains due. No refund or credit will be provided.

3. Immediate Loss of Cancellation Rights: Notwithstanding Section 6.2, the right to any refund or credit is waived immediately once digital Course Materials have been accessed by any Learner, or LMS login credentials have been issued to the Learner(s).

4. Learner Substitutions (Transfers): The Buyer may substitute one Learner for another at no additional cost, provided that the new Learner meets all course prerequisites and full Learner Enrollment Data for the substitute is provided at least 3 business days prior to the course start date. If a substitution occurs after Course Materials or LMS access have been issued to the original Learner, an administrative fee of €50 will apply to reset the account and re-issue materials.

5. No-Shows: If a Learner fails to attend the course for any reason, the Buyer remains liable for the full Course Fee. No refunds, credits, or free transfers to future dates will be provided for No-Shows.

  • Submissions, Extensions and Deadlines
    1. Submission Dates: Upon registration, Learners will be provided with specific submission dates for their assessments. It is the responsibility of the Buyer to ensure that Learners are aware of and adhere to these deadlines.
    2. Extension Requests: Requests for extensions must be submitted in writing. Forus Training retains the sole discretion to grant or deny extensions based on the circumstances provided.
      1. When applying, the Learner must specify the exact duration (days/weeks) required.
      2. A maximum of two (2) extensions may be granted per module.
    3. Extension & Late Fees: Fees for extensions and late submissions are applied as follows:
      1. First Extension: A fee of €60 applies.
      2. Second Extension: A fee of €120 applies.
      3. Late Submission: Any assessment submitted after the final agreed deadline without a prior extension is subject to a €150 late submission fee.
